Terms of Service

These Terms of Service ("Terms") govern your use of the Bethany mobile application and website (joinbethany.com) operated by Halak Labs LLC ("we," "us," "our"). By creating an account or using the Service, you agree to these Terms.

1. Eligibility

• You must be at least 13 years old to use Bethany.
• Users between 13 and 17 must have parental or guardian consent.
• You must provide accurate, current, and complete information when creating your account.
• You are responsible for maintaining the confidentiality of your account credentials.

2. Account Registration

You may create an account using email/password or third-party authentication (Google). You agree to provide truthful registration information, maintain account security, notify us of unauthorized access, and accept responsibility for all activity under your account.

3. Acceptable Use

Bethany is a faith community. You agree NOT to:

• Post content that is hateful, harassing, threatening, or discriminatory
• Post sexually explicit or pornographic content
• Post content that promotes violence, self-harm, or illegal activity
• Spam, solicit, or advertise products or services
• Impersonate another person or misrepresent your identity
• Attempt to access other users' accounts or data
• Use automated systems (bots, scrapers) to access the Service
• Reverse engineer, decompile, or disassemble the Service
• Post content that infringes on any third party's intellectual property rights

4. User Content

Your Content: You retain ownership of content you create (prayer requests, notes, highlights, group messages). By posting content publicly, you grant us a non-exclusive, worldwide, royalty-free license to display and distribute that content within the Service.

Content Removal: We reserve the right to remove content that violates these Terms. We will notify you if content is removed, unless prohibited by law.

5. Scripture and Third-Party Content

Bible text is provided through third-party APIs. Scripture quotations are the property of their respective copyright holders. Bethany does not claim ownership of any Bible translation. Background images in the verse sharing feature are sourced from Unsplash under the Unsplash License.

6. Privacy

Your use of the Service is governed by our Privacy Policy. By using the Service, you consent to the practices described therein.

7. Intellectual Property

The Bethany name, logo, and all related branding are the property of Halak Labs LLC. The Service's design, code, and features are protected by copyright and intellectual property laws. You may not copy, modify, distribute, or create derivative works without our written permission.

8. Disclaimer of Warranties

The Service is provided "as is" and "as available" without warranties of any kind, either express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

We do not warrant that the Service will be uninterrupted, error-free, or secure. Bethany is not a substitute for professional counseling, therapy, or medical advice. If you are experiencing a crisis, please contact emergency services.

9. Limitation of Liability

To the maximum extent permitted by law, Halak Labs LLC shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, revenues, data, use, or goodwill, resulting from your use of (or inability to use) the Service, any conduct or content of third parties, or unauthorized access to your data.

10. Indemnification

You agree to indemnify, defend, and hold harmless Halak Labs LLC and its officers, directors, employees, and agents from any claims, liabilities, damages, losses, and expenses arising from your use of the Service or violation of these Terms.

11. Termination

We may suspend or terminate your account for violating these Terms. You may delete your account by contacting hello@halaklabs.com. Upon termination, your right to use the Service ceases immediately.

12. Governing Law

These Terms are governed by the laws of the State of South Dakota. Any disputes shall be resolved in the courts of Minnehaha County, South Dakota.

13. Dispute Resolution

Before filing a claim, you agree to attempt to resolve disputes informally by contacting hello@halaklabs.com. If we cannot resolve the dispute within 30 days, either party may pursue formal proceedings.

14. Changes to These Terms

We may update these Terms from time to time. Continued use after changes constitutes acceptance.
